We handle any claim if and when it arises, but for GIASIL, claim management doesn’t start when concrete demands are made. We already set the course at the very beginning of a project, in the course of drafting and negotiation of contracts. However, despite careful planning and management; time extension, extra work, hold-ups, delays … do come up during a project.
In a contract, no party is prepared to take extra financial or other burden for the default, omission and commission of any other party. Usually claims are made for compensation which is believed to be due. GIASIL offers you expert assistance in all matters of claim management. We usually try and settle cases before they go to trial. A considerate approach for early settlement on issues between parties is always cheaper and generally leads to win/win results.
We start by determining whether or not the claim has any basis in the contract or in law. We base ourselves on contracts, documents, additional information and make a thorough analysis to measure the real project performance. We are thus able to determine the reasonable value of the claim and to justify the requested compensation. On the one hand, GIASIL makes sure parties are correctly compensated for any loss or damage. On the other hand we will ensure that no party unduly has to pay too large a compensation.
